POWERUP RESIDENTIAL ELECTRIC VEHICLE OFF-PEAK CHARGING PROGRAM
TERMS AND CONDITIONS
1. CONDITION OF PROGRAM
The City of Westerville - Westerville Electric Division (“City”) PowerUp Residential Electric Vehicle (EV) Off-Peak Charging Program (“Program”) offer to Residential Customers (“Customer”) is subject to available funding and the terms and conditions contained herein. Customer’s completion and submission of the electronic application shall constitute the Customer’s acceptance of these terms and conditions and consideration by both parties to form a binding agreement. No changes to the terms and conditions or the Program, shall be binding unless the City agrees in writing.
2. PURPOSE
The City of Westerville strives to improve the community’s energy and transportation sustainability. To this effort the City is working to increase the adoption of EVs and encourage cheaper, off-peak EV charging within the community by offering a reduced EV charging rate and a one time rebate payment to single family residential customers.
3. PROGRAM AGREEMENT
The Customer must complete the electronic program application and agree to the program’s terms and conditions. Application information and any accompanying documentation become the property of the City upon submission.
4. CUSTOMER ELIGIBILITY
- The Customer must be a Westerville Electric Division paying customer without a delinquent balance.
- The Customer must own or lease a plug-in EV.
- The Customer must agree to participate in the Program for three years.
- The Customer must pay for a qualified electrician to install a separate, dedicated 240V circuit for EV charging only. A dedicated sub-meter must be installed in the circuit and located on the exterior of the home to ensure reliable communication to the Westerville Electric Division. The Westerville Electric Division will provide and install the sub-meter free of charge.

5. RESIDENTIAL EV CHARGING STATION
This program offers residential customers the opportunity to install and use any type of residential level 2 EV charging station they prefer whether that be a standard, non-WiFi connected charger or a smart WiFi connected charger. Units can either be hardwired or connected via a 240V outlet. The only requirement is that the charger be installed downstream of the dedicated sub-meter. Popular EV charger brands include Tesla Home Wall Connector, ChargePoint Home Flex, JuiceBox Smart, Siemens VersiCharge, and ClipperCreak HCS- 40. The customer is responsible for paying for and managing the entire installation of the dedicated EV circuit including the 100 Amp sub-meter base located on the exterior of the home and their preferred EV charger.
6. SUB-METER
The dedicated sub-meter must be located on the exterior of the home at a height of five feet plus or minus six inches above the final grade and in a safe and accessible location, preferably near the existing primary house meter. This ensures consistent reliable communication to the Westerville Electric Division and provides accessibility as needed to metering staff. Reference Section 6 of the City of Westerville Electric Division Terms and Conditions of Electric Service for further details. The sub-meter is our standard residential AMI meter used in our residential metering applications. The sub-meter will be installed once the 240V circuit is installed and has passed all necessary inspections.
7. OFF-PEAK CHARGING
The program offers a credit at the rate of $0.04/kWh for off-peak EV charging. The off-peak hours occur from 8:00pm-6:00am, Monday-Friday and include all hours on Saturday and Sunday. All energy used during this time frame will be calculated on a monthly basis and appear on your electric bill as a credit line. Section 13 provides details on how this program works with customers who have solar installations and participate in our Net Metering Program.
8. REBATE
The Rebate is a one time payment in the amount of $300. Payment will be made via mailed check within eight weeks of an approved application and installation of the sub-meter.
9. PROGRAM SUBJECT TO AVAILABILITY
Program participation is limited and Rebates are not guaranteed; The Customer must timely comply with the City’s application process in order to enroll in the program and receive a Rebate payment. Rebates will be awarded at the City’s discretion upon compliance with the terms of this Program, and on a first come, first served basis. The Program may be modified without prior notice and may be terminated when the City determines the Program goals are met or funds are exhausted.
10. CONSTRUCTION AND INSTALLATION
It is the Customer's responsibility to manage the installation contractor(s). The Customer is solely responsible to pay any contractors for the construction of the electrical upgrades and/or EV charging stations.
11. PERMITS
The Customer shall obtain and comply with all permits required by the City, State of Ohio, property owner, and/or homeowner association requirements regarding local conditions, restrictions, codes, rules, and regulations for, among other things, the installation of the dedicated circuit, exterior meter box and/or EV charging equipment. The Customer shall obtain such permits prior to the initiation of any electrical work.
12. INSPECTION AND METER INSTALLATION
Upon application approval and installation of the circuit, a metering technician will visit the site to install the sub-meter and conduct an on-site inspection to verify that all conditions of the Program are satisfied prior to enrollment and Rebate payment. The Customer agrees to provide City representatives reasonable access to the installation location/site upon request and during normal business hours.
13. NET METERING AND BILLING
Customers with solar installations that participate in our Net Metering Program are still able to participate in this Program. The EV off-peak charging credit will only apply to monthly bills where the customer has an Energy Charge and Power Supply Cost Adjustment Charge. The Off-Peak EV Charging Credit will provide a maximum net zero cost offset for the combined energy charges. It will not be applied to offset the Customer Charge.
14. INDEMNIFICATION
Upon acceptance into the program, the Customer hereby agrees to indemnify, defend, and hold harmless the City (including its elected and appointed officials, officers, and employees) for and from any and all claims or actions of any kind presented against the City arising out of Customer’s (including Customer’s employees, representatives, agents, contractors, and sub-contractors) performance under this Agreement, excepting only such claims, costs, or liability which may arise out of the sole negligence of the City. Further, the City makes no warranty and is not responsible for any representations, whether expressed or implied, including, but not limited to, the warranty of merchantability, fitness, performance, and longevity for any particular purpose, use, or application of the item(s) or measure(s), manufacturers, dealers, contractors, or any other third parties, materials, workmanship, the quality, safety and/or installation of the item(s) or measure(s), effects on pollutants or any other matter with respect to the Program. Moreover, the City shall not be responsible for workmanship including, but not limited to, quality of electrical upgrades and EV charging station equipment installation or the installer’s failure to comply with applicable laws and/or safety standards.
